These Terms and Conditions (“Terms”) govern the use of services provided by Embakai Tech Solutions (“we,” “our,” “us”). By engaging our services, you (“Client,” “you”) agree to these Terms.

1. Scope of Services

We provide a range of digital solutions, including but not limited to:

  • Website Design & Development
  • Mobile App Development
  • Hosting & DevOps
  • Cybersecurity Solutions
  • AI & Automation
  • Digital Marketing & SEO
  • Design & Branding
  • Consulting & Tech Support
  • Content Solutions

2. Free Domain & Hosting Offer

  • A free domain name and hosting package is provided only to clients who order our Website Design packages or services that require both.
  • This offer is valid for the lifetime of the service, provided the client maintains annual renewal fees for hosting and domain management.
  • .com.pg, .net.pg, .org.pg, and all other .pg domains incur additional charges as set by the registry.
  • Domains and hosting remain under Embakai Tech Solutions’ management unless otherwise agreed in writing.

3. Client Responsibilities

  • Provide accurate project details, content, and approvals in a timely manner.
  • Ensure compliance with all applicable laws and regulations regarding content and data.
  • Maintain confidentiality of login credentials and access details provided.

4. Payments & Billing

  • All invoices must be paid according to the agreed schedule.
  • Late payments may result in suspension of services.
  • Subscription‑based services (e.g., hosting, maintenance) are billed in advance.

5. Refunds & Cancellations

  • Refunds are subject to our Refund and Returns Policy.
  • Custom development and digital services are generally non‑refundable once work has commenced.
  • Hosting and subscription cancellations take effect at the end of the billing cycle.

6. Intellectual Property

  • Upon full payment, clients own the final deliverables (website, app, branding assets) unless otherwise agreed.
  • Embakai Tech Solutions retains rights to pre‑existing frameworks, plugins, or proprietary tools used in development.

7. Data Security & Privacy

  • We apply a security‑first approach across all services, including encryption, firewalls, and compliance monitoring.
  • Personal data is handled in accordance with our Privacy Policy.

8. Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
  • Service downtime due to third‑party providers (e.g., hosting, payment gateways) is outside our control.

9. Termination of Services

  • We reserve the right to suspend or terminate services if these Terms are violated.
  • Clients may terminate services with written notice, subject to outstanding payments and obligations.

10. Governing Law

These Terms are governed by the laws of Papua New Guinea. Any disputes will be resolved under PNG jurisdiction.

11. Updates to Terms

We may update these Terms from time to time. The latest version will always be available on our website.
