These Terms and Conditions (“Terms”) govern the use of services provided by Embakai Tech Solutions (“we,” “our,” “us”). By engaging our services, you (“Client,” “you”) agree to these Terms.

Our services may integrate with third-party platforms, including Meta and WhatsApp. A client's use of those platforms is also subject to their current terms, policies, availability, review or approval processes, permissions and technical limitations. Embakai Tech Solutions does not control third-party platform decisions, outages or policy changes and cannot guarantee continued access or approval.
Clients using business messaging, AI-assisted support or automation services are responsible for obtaining lawful permission or consent where required, providing required notices, honouring opt-out requests, and complying with applicable laws and the current Meta and WhatsApp policies. Clients must not send spam, use purchased or unlawfully obtained contact lists, mislead recipients, or use the service for unlawful or abusive activities.
Clients must provide an appropriate path for a recipient to reach human or direct support when an automated conversation cannot adequately resolve a request. Embakai Tech Solutions may limit or suspend an automation or integration where reasonably necessary to protect platform integrity, security, users or compliance.

These additional terms apply to every applicant and approved participant in the Embakai Affiliate Program.
You must use your own Embakai Client Area account and provide accurate application information. Applications are reviewed manually. Submitting an application does not guarantee approval. Referral tools remain unavailable until Embakai Tech Solutions approves the application.
Commission applies only to products marked as affiliate eligible in the affiliate dashboard when the referral is made. Eligible products, commission rates, campaigns and availability may change. Website development, web application development, e-commerce development and mobile app development products may be included when enabled by Embakai Tech Solutions.
You must use referral links generated by the affiliate dashboard. The current attribution window is 30 days from a qualified click. The last qualified referral recorded within that window is used unless a valid affiliate coupon or campaign rule applies. Tracking can be affected when a customer blocks or clears cookies, changes devices, or completes an order outside the attribution window.
Commission is created only for an eligible order after payment is confirmed. Quotes, enquiries, unpaid orders, taxes, discounts, domain costs, refunds, chargebacks, reversals, cancelled orders and non-commissionable items do not earn commission. A commission remains pending during the current 14-day validation hold and becomes available only after review.
You must describe Embakai products accurately and use approved brand materials. You must not make false guarantees, impersonate Embakai Tech Solutions, send spam, use purchased contact lists, bid on Embakai brand terms in paid search without written approval, use cookie stuffing, conceal referral links, create misleading discounts, or interfere with another affiliate's attribution.
Self-referrals, related-party transactions created mainly to earn commission, duplicate accounts, automated or fraudulent traffic, and manipulated orders are prohibited. Embakai Tech Solutions may investigate traffic and orders, delay approval, reject or reverse commission, and suspend or terminate an affiliate account where activity is invalid, abusive or inconsistent with these terms.
Affiliate payouts are made by bank transfer in PGK. You must provide an accurate bank name, account name and account number in your affiliate profile. You are responsible for ensuring the account can receive the transfer. The current minimum payout is K100 in available commission. New or changed bank details are subject to a 48-hour security hold. Bank charges or fees applied by a financial institution may reduce the amount received.
You are responsible for any tax, registration, reporting or other legal obligations connected with your affiliate earnings. The affiliate dashboard and Embakai ledger are the official records for tracked clicks, conversions, commission adjustments and payouts.
Embakai names, logos, product content and marketing assets remain the property of Embakai Tech Solutions or their respective owners. Approval gives you a limited, revocable right to use approved materials only for lawful affiliate promotion. Non-public customer, pricing, security or business information must remain confidential.
Either party may end participation. Embakai Tech Solutions may suspend or terminate access for breach, fraud, legal or security risk, inactivity, or material harm to the brand or customers. Valid earned commission remains subject to review, holds, reversals and these terms. A material program change may be published as a new version and require acceptance before referral tools can be used again.
The program is provided subject to service availability and third-party payment, hosting and network systems. To the extent permitted by law, Embakai Tech Solutions is not responsible for indirect or consequential loss caused by unavailable tracking or third-party services. These terms are governed by the laws of Papua New Guinea.
